Terms of Service

1. Acceptance of Terms

By accessing or using deploy.build ("the Service"), including our website, APIs, and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and deploy.build.

2. Description of Service

deploy.build provides pre-configured cloud servers with AI development tools. Our platform allows you to deploy, manage, and access virtual private servers that come pre-installed with a curated set of AI coding tools.

Servers are provisioned through third-party cloud infrastructure providers. While we strive to maintain high availability and performance, the underlying infrastructure is operated by these third-party providers and is subject to their own terms, conditions, and service level agreements.

3. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information to keep it accurate and complete
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Each person may only maintain one account. Creating multiple accounts may result in termination of all associated accounts.

4. Payment & Billing

All server fees are charged at the time of provisioning. Servers are billed on a monthly recurring basis from the date of deployment. Prices are displayed in USD and are inclusive of our service fees.

No refunds. Because servers are provisioned instantly using real cloud resources from third-party providers, we are unable to offer refunds once a server has been deployed. The resources are allocated immediately upon payment and incur costs on our end from the moment of provisioning.

You may cancel your subscription at any time. Upon cancellation, your server will remain active and accessible until the end of your current billing period. No further charges will be made after cancellation, and the server will be deprovisioned at the end of the paid period.

5. Acceptable Use

You agree not to use the Service for any unlawful or prohibited purpose. Specifically, you must not:

• Engage in any illegal activities, including but not limited to fraud, distribution of malware, or hosting illegal content
• Launch attacks against other systems, networks, or services (including DDoS, port scanning, or brute-force attacks)
• Engage in cryptocurrency mining unless specifically permitted under your server plan
• Send unsolicited bulk communications (spam) or host infrastructure used for spamming
• Abuse server resources in a manner that degrades performance for other users
• Attempt to gain unauthorized access to other accounts, servers, or systems
• Violate any applicable local, national, or international laws or regulations

Violation of these terms may result in immediate suspension or termination of your account without refund.

6. Server Resources

Servers are provisioned on shared cloud infrastructure. While each server has dedicated CPU, RAM, and storage as specified in your plan, network bandwidth and certain I/O resources are shared among users on the same physical host.

A fair use policy applies to all server plans. Excessive or sustained CPU usage, bandwidth consumption, or I/O operations that negatively impact other users may result in throttling, resource limits being applied, or a request to upgrade to a higher-tier plan. We will make reasonable efforts to notify you before taking any such action.

7. Intellectual Property

Your content. You retain full ownership of all code, data, applications, and content that you create, upload, or store on your servers. deploy.build claims no intellectual property rights over your content.

Our platform. deploy.build and its licensors retain all rights, title, and interest in and to the Service, including the platform, website, branding, logos, documentation, and all related software and technology. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if we determine that you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties.

You may delete your account at any time through your account settings or by contacting our support team. Upon account deletion:

• All active servers will be deprovisioned at the end of the current billing period
• Your account data will be permanently deleted within 30 days
• Any remaining prepaid balance is non-refundable

9. Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

deploy.build shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data stored on your servers
• Server downtime or service interruptions
• Issues caused by third-party cloud infrastructure providers
• Loss of revenue or profits resulting from service unavailability
• Unauthorized access to your servers due to compromised credentials

You are solely responsible for maintaining backups of all data stored on your servers. In no event shall our total liability exceed the amount you have paid to deploy.build in the twelve (12) months preceding the claim.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and, for material changes, we may notify you via email or a prominent notice on our website.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
